APPLICANT AGREEMENT

The Applicant Agreement (hereinafter referred to as "Applicant Agreement") governs inter alia your business conduct, ethics and practices as Applicant ("Applicant").

Think Osem Sdn Bhd (Company No.1019329-D) (hereinafter referred to as "Think Osem") reserves the right to amend or update the Applicant Agreement and it is your responsibility to check the Think Osem official website from time to time for any amendments or updates to the Applicant Agreement. In any event, your continued participation in and conduct of the business will constitute your agreement to be bound by and adhere to the amended or updated Applicant Agreement.

  1. Applicants must be at least 18 years old and authorized to work in their state of residence.
  2. Applicants agree to abide by the official Think Osem Policy & Procedure and warrant that they understand the compensation requirements specified in the Compensation Plan.
  3. An applicant that completes an application to become an Affiliate with the Think Osem agrees to receive electronic emails.
  4. The Think Osem reserves the right to reject an application or immediately terminate any existing contract if it is determined that the particulars provided during enrolment is incorrect or invalid.
  5. Applicants hereby applies to be authorized as an affiliate in Affiliate Marketing Program for Think Osem. In case of rejection of this application, Think Osem will inform the applicant within 21 days. For a period of 21 days after delivery of this Application, or until such time Think Osem Applicants inform about acceptance or rejection of this application, Applicants is authorized temporarily to become an affiliate and the right to sell products Think Osem.
  6. Think Osem has right to accept or reject any application for any reason, in accordance with the terms and conditions set out in the Think Osem Policy, as existing or amended or any appropriate reason
  7. Upon submitting this application, applicant has read and agree to be bound by the terms of the Affiliate Agreement, Think Osem Rewards and Think Osem policies and procedures, the Code of Ethic, the Website General Terms, all of which are included herein by reference for all purposes, is part of this Applicant Agreement.

AFFILIATE AGREEMENT

The Affiliate Agreement (hereinafter referred to as "Agreement") governs inter alia your business conduct, ethics and practices as Applicant (“Affiliate”) as well as your relationship with other Affiliate and multi-level marketeers in the industry. As an Affiliate, you must read and fully understand the Code and must strictly adhere to the same in every respect.

Think Osem Sdn Bhd (Company No.1019329-D) (hereinafter referred to as "Think Osem") reserves the right to amend or update the Agreement and it is your responsibility to check the Company’s official website from time to time for any amendments or updates to the Agreement. In any event, your continued participation in and conduct of the business will constitute your agreement to be bound by and adhere to the amended or updated Agreement.

  1. Think Osem will not:
    • Guarantee success;
    • Provide any commissions/bonuses for the recruitment of others;
    • Tolerate Affiliate pressuring prospects or downline into purchasing large quantities of inventory;
    • Allow misleading product claims to be made in any form;
    • Tolerate Affiliate “stocking-up” on products merely to obtain commissions/bonuses;
    • Advise an Affiliate on meeting compensation qualifications;
    • Represent that there is any substitute for hard work.
  2. Any payment include product purchasing strictly Non Refundable once activated in the system.
  3. Affiliates shall not sell products on online marketplaces.
  4. Affiliates shall not sell any of the products below than the market price, such actions will lead to termination.
  5. Affiliates are strictly prohibited from engaging in any spamming activities. This includes sending unsolicited emails, messages, or other forms of communication that could be considered spam.
  6. Affiliates must not use the Think Quran affiliate program database to promote other products or services that are not related to Think Osem.
  7. No overclaiming. Affiliates are not allowed to make exaggerated or false claims about Think Osem products. All marketing must adhere to the facts provided by Think Osem, and affiliates must not mislead customers in any way.
  8. Affiliate is an independent contractor in accordance with the terms of this Agreement, not an employee or legal representative of his or her sponsor Think Osem, and cannot in any way recognize themselves as such. Therefore, no power to bind Reseller Think Osem for any duties and Reseller is responsible for all income involved, licenses or charges caused by activities Reseller below.
  9. Affiliates not allowed producing, promoting, or using any kind of material that reflects / use Think Osem name, plans, products and trademarks, and copyrighted material Think Osem’s or other controlled substances, except as permitted under the guidance Think Osem policies.
  10. Affiliate has the responsibility to supervise and train affiliates who may sponsor him, as stated in the Agreement. Affiliates will explain Think Osem programs honestly and in making service to others. Affiliate understands and will explain when to make delivery, as follows: Think Osem or programs not give any guarantees of income; Affiliate will earn money based solely on sponsorship; none of the specific products that used to be purchased at all levels; commission is based on the total sales of the product: that there are no exclusive territories for Affiliate in the program.
  11. Any sale or assignment of this Agreement or Affiliate authorization must be approved in writing by Think Osem. Successors in interest or assigns must comply with all the requirements of this plan.
  12. Any breach, non-compliance or violation of the Agreement is a serious matter and may result among other things in termination of your Affiliate Marketing Program.
  13. Any Affiliate that is terminated and/or cancels his or her Affiliate, shall not compete with the Company or any of its affiliates by soliciting existing customers of the Company to any Think Osem or business similar to the Company in a multi-level marketing setting or its equivalent, for a period of twelve (12) months.
  14. Violations of the Agreement are especially detrimental to growth and sales, and the Company may seek and obtain damages for violations of this Agreement.
  15. Venue and jurisdiction for any legal action relating to this Agreement or any disputes or claims between the parties under this is in Malaysia. This Agreement is subject to the laws of Malaysia, except if the law of your jurisdiction expressly require its own laws.
  16. Maintenance Policy
    1. Affiliate is required to become Active each calendar month by performing ANY of this action :
      1. Direct introduced affiliate purchase at least 1 Business Center
      2. Make Think Quran PLUS activation or donation
    2. Active Affiliate might enjoy :
      1. Monthly Bonuses include Executive Mentor Bonus and Car Bonus
      2. APV carry forward to next month up to 200, 000 APV
    3. Flushing occurs in the certain event:
      1. Failed to become ACTIVE affiliate in a month, flush all APV except for the largest leg up to 5000 RPV
      2. Successfully become ACTIVE affiliate, on up to 200,000 APV, any APV higher than 200, 000 APV will be flushed
    4. Flushed RPV or missed bonuses are not refundable or claimable.
    5. Failure to become active user by maintaining at least 75 APV purchase within twelve (12) months will lead to termination.
  17. Cooling-off period
    1. Affiliates are entitled for ten (10) days cooling-off period from the purchase date after receiving email on successfully registered as a affiliate and entitled to request for refund and terminate affiliate account.
    2. To remain compliant with the deadline for the cooling-off period, affiliate is required to contact administration and do confirmation through their own account before the end of cooling-off period date
    3. Think Osem retains the rights to terminate the applicant's affiliate account immediately upon receiving confirmation.
    4. Affiliates must return all the non-digital product purchased in a good condition within fourteen (14) days from the application date to be entitled for refund.
    5. Think Osem will refund to the affiliate the total amount of non-digital product returned, digital products that have not been activated or donated minus any commissions/bonus received by the affiliate and 10% processing fee within sixty (60) days from our receipt of your cooling-off request
    6. Any payment including product purchasing is strictly Non-Refundable if the ten (10) days cooling off period has ended.
    7. Your APV and expected income will be affected in the case of Affiliates in your network opting for refund during the cooling-off period.
  18. The ownership of the affiliate account is non-transferable, except in the case of the account holder's death, where it may be transferred solely to the designated heir.
  19. The acceptance of this Agreement hereby acknowledges that he is on the side of legal age and authorized to bind the Affiliate to each the terms specified in this Agreement.

DIGITAL CARD

  1. Any lost or stolen digital product will be at your own risk. Please keep your password safe to protect all your personal belongings in the affiliate.thinkquran.com. .
